Ashcroft Resigning b/c Its Easier Than Learning About Checks and Balances

God help us, now the Attorney General essentially wants to take away the right to judicial review completely. Why not just make the President a dictator and make it official??

"The danger I see here is that intrusive judicial oversight and second-guessing of presidential determinations in these critical areas can put at risk the very security of our nation in a time of war."

Oh. Excuse me. Evidentally, we have to teach the attorney general what a college student learns in political sciences classes and what a law student learns first year. Judicial review is exactly what keeps the president from being an elected king. That entire separation of powers thing?? Checks and balances? Framers were kinda specific about it. Framers kinda really wanted that in the Constitution. You know, keeping any branch of the government from having too much power. That whole judiciary thing? Yeah, they kinda wanted them to be able to prevent the majority from ruling with an iron fist. The majority can't just take it away.

    I bitched about this, too. Marbury v. Madison gave us judicial review so that the judicial branch could have the power it needed to do its job. It's wonderful when the Attorney General cannot understand that. Obviously, Ashcroft doesn't give a damn about the Constitution, so it makes sad, sad sense that he doesn't understand checks and balances.

    Oh, what am I saying? Bush needs MORE power. He can never have ENOUGH power. Stack the Cabinet with even more sycophants!!

    steph - this is really sad, but really funny the way you expressed it. i laughed ... partly out of humor and partly out of nervousness for the state of our country.

    sarah - the first thing i learned in sophomore poli-sci in high school - marbury madison = judicial review. my teacher said if we learned only one thing in her class to learn that!
